SUMMARY OF DUTIES:
This position is responsible for the management of Amtrak’s personal injury claims assigned to Amtrak’s Chicago, IL, Beech Grove, New Orleans Claims offices and staff, including without limitation: their structure, organization, and staffing, operations and the implementation of claims policies, processes, protocols, practices with respect to claims handling investigations and disposition; claims process training and process assurance; interface and coordination with in-house and outside counsel; management of relationships, policies and practices concerning other vendors and program partners (including medical management and support resources); and results and effectiveness for the company.

 

 

ESSENTIAL FUNCTIONS:

  • With guidance from supervising Senior Manager, is responsible for the fair and efficient and “in the best interest of Amtrak” handling and disposition of personal injury claims made to the company, or the company’s claims against third parties, and related litigation.
  • Directs and supervises Claims Specialists in their handling of Amtrak’s internal personal injury and property damage claims, including without limitation, ensures appropriate staffing and that staff are trained, that staff are following Claims policies, processes, protocols and practices; ensures budget guidance is followed and manages the use of outside vendors; ensures that staff are appropriately handling and disposing of claims; manages interface and coordination with in-house and outside counsel and other vendors and partners (including medical management resources); achieves positive results and effectiveness for the company for their respective offices and types of claims.
  • Specifically with respect to claims handling and  disposition:
  • Mentors claims professionals in office or function by providing strategic claims management guidance and enabling the claims professionals to execute on the agreed upon strategy.
  • Evaluates cases to determine the most reasonable and cost-effective manner of disposition.
  • Supervises investigations, settlement negotiations and litigation handled by Claims staff and outside counsel.
  • Participates in settlement negotiations and mediations of high exposure cases.
  • Oversees office and staff’s interface and coordination with inside counsel and outside counsel pursuant to applicable Law Department policies on Claims matters and tort litigation requiring counsel.  In this capacity, works with supervising Senior Manager, Managing Deputy General Counsel and assigned tort litigation attorney to engage outside counsel and develop litigation strategy.
  • With supervising Senior Manager and Managing Deputy General Counsel, convenes for regular case status and strategy reviews with outside counsel.
  • Oversees management of caseloads to ensure thorough and time prosecution and defense of claims.
  • Works to develop and keep current Claims’ training programs, peer review program for Claims office or function and to ensure consistent application and implementation of Claims policies, processes, protocols and practices.
  • Ensures office and staff are working with Amtrak Health Services and Amtrak’s Senior Manager, Right Care Day One (RCD1) and external medical services to support availability of robust and responsive medical support resources and, where appropriate, transitional work, for injured claimants.
  • With guidance from the AVP and supervising Senior Manager, develops with other Claims Managers goals and metrics for Claims staff annual performance review program.
  • Responsible for managing office or function use and cost of outside vendors other than outside counsel.
  • Ensures uniform implementation within Claims group of all generally applicable Amtrak and Law Department policies, processes, protocols and practices.
  • Monitors electronic database to ensure that assigned files are managed and kept current according to departmental standard guidelines.
  • Represents Claims and Law Department on cross-functional risk management committees at the direction of the AVP or supervising Senior Manager to develop collaborative partnerships with Operating Departments in support of the corporate Strategic Business Plan.
  • Supports supervising Senior Manager and AVP in work with Chief Safety Officer to advance safety and accident prevention policies, programs, processes, practices and initiatives across Amtrak operations and services.
  • When requested or assigned by the supervising Senior Manager, represents Amtrak Claims group within railroad industry and at conferences concerning the management and adjustment of and litigation concerning personal injury claims and property claims.

 

 

MINIMUM QUALIFICATIONS:

  • BA/BS degree or equivalent work experience.
  • Substantial experience handling and managing tort claims and/or property damage claims litigation and coordinating with inside counsel and outside counsel on same, preferably in a railroad environment.
  • Maintains a thorough understanding of the claims industry and trends to assist in the identification of positive and adverse impacts.
  • Ability to exercise discretion while working and communicating in confidential settings with sensitive information.
  • Familiarity with applicable federal and state laws, rules of evidence, court rules to support responsibilities and work with inside and outside counsel productively for the company of Federal and State court rules and procedures sufficient to assure compliance by the corporation.
  • Ability to proficiently use Microsoft Office Suite.

  • Experience demonstrating skill formulating and executing strategies for handling tort claims and lawsuits.
  • Experience demonstrating skill directing complex investigations through staff by way of recorded/written statements, scene photography, detailed interviews of witnesses, background information, search of medical history and other investigative techniques.
  • Experience demonstrating skill managing and conducting settlement negotiations.
  • Experience demonstrating skill creating, defining and implementing corporate policies for the handling and disposition of claims/litigation.
  • Experience demonstrating skill granting appropriate settlement authority through proper case evaluation.
  • Experience demonstrating skill selecting, evaluating, advising and directing outside counsel in the handling of litigation matters sufficient to assure competent representation and protection of company interests.
  • Ability to ensure effective caseload management and litigation support to minimize risk to Amtrak while controlling claims costs, legal fees and expenses.

 


PREFERRED QUALIFICATIONS:

  • AIC, ARM or other advance industry program certificates.
  • Demonstrated experience examining accident causation trends and patterns from a risk management perspective sufficient to help other departments develop and maintain effective risk management standards.
  • Experience demonstrating knowledge of Force Account, Railroad Protective and other insurance policies sufficient to assure coverage that will protect the corporation’s interests.
  • Experience in progressively responsible supervisory positions including middle management
  • Experience demonstrating sufficient knowledge of tort law including FELA, complex claims investigations, case evaluation and settlement negotiations to supervise Claims staff and outside counsel and make business decisions.
  • Working knowledge of contracts and agreements with vendors, freight railroad and commuter agencies sufficient to assure compliance with indemnity obligations.
  • Works with AVP, supervising Senior Manager and Business Services Specialists on development and management of Claims group budget for each fiscal year.
  • Frequently works in a crisis situation, requiring fast, long-reaching decisions
