Work Arrangements
It is Amtrak’s policy to allow or require remote work, through one of the flexible work arrangements described below, and as explained in Amtrak’s Work Arrangement Policy, P/I 7.41. To learn which work arrangement(s) is available for a position, please refer to the job posting. Below is an explanation of each work arrangement.
Onsite Work Arrangement
The position requires work to be performed from an Amtrak work location 4 or more days per week.
Hybrid Work Arrangement
The position requires work to be performed from an Amtrak work location on a regular basis, up to 3 days per week and generally at least 2 days per month. For the remaining time, the individual may, for their own convenience, work remotely, consistent with the requirements of the individual’s department and those listed under Remote Work Rules.
- Hybrid Monthly – the individual is to work at an Amtrak location 2-3 days per month
- Hybrid Weekly – the individual is to work at an Amtrak location 1-3 days per week
Remote Work Arrangement
The individual works from a non- Amtrak U.S. location, such as the individual’s home, without scheduled days at an Amtrak work location. Travel is expected to be minimal (0-5%).
- Remote – Option
Amtrak has determined that the position does not require work to be performed remotely. To promote flexibility, the individual may choose to work remotely for their own convenience, consistent with the requirements of the individual’s department and those listed under Remote Work Rules. See Tax Implications for Remote Optional Positions for additional information. - Remote - Required
Amtrak has determined that a fully remote work arrangement is required for this position. A dedicated workspace at an Amtrak location will not be provided. Remote work must be performed consistent with the requirements of the individual’s department and those listed under Remote Work Rules.
Traveling Work Arrangement
The position requires travel to a variety of locations for a substantial amount of time. Dedicated Amtrak workspace will not be provided. When not traveling, the work should be performed from the individual’s remote location, consistent with the requirements of the individual’s department and those listed under Remote Work Rules.
Remote Work Rules
When working remotely under any of the four work arrangements, employees must ensure the following:
- Work remotely from a U.S. location such as the employee’s home or another non-Amtrak U.S. location.
- Use of a dedicated workspace that is used exclusively for performing Amtrak work.
- Access to reliable high-speed internet, and smart phone service capabilities.
For positions with Remote-Option, Remote-Required and Traveling work arrangements, the remote location must be located in the contiguous United States.
Tax Implications for Remote Optional Positions
With regard to tax withholdings, please review the following information. There are several jurisdictions that follow a “convenience of employer” rule. Under this rule, an employee working for an employer whose office is located in one state, but who performs their work from a remote location in another state, is subject to the tax laws of their employer’s state unless the work arrangement is done for the convenience of the employer. If an employee can choose to work remotely (i.e., they are not required to work remotely by their employer), they would still be subject to tax in the employer’s state. The employee may also be subject to tax in the remote location state if that state imposes an income tax. As a result, individuals working for employers located in states that have adopted the convenience of employer rule are often subject to double taxation (i.e., they must pay income taxes in their resident state as well as their employer’s state). However, many states allow a credit for taxes paid to other states to reduce the potential of double taxation. Amtrak does not provide tax advice to its employees on this or any other matter. Consult your tax advisor if you have any questions in these situations or on any related matter.
The following jurisdictions apply the convenience of employer rule: Arkansas, Delaware, Nebraska, New York and Pennsylvania. Connecticut and New Jersey also apply the convenience of employer rule but only if the taxpayer’s resident state applies a similar rule for work performed for a Connecticut or New Jersey employer. (For example, a New York resident working at home for a Connecticut employer will fall under the convenience rule, since New York has implemented the convenience rule.) Several cities in these jurisdictions also impose an income tax and apply the convenience of employer rule including Philadelphia, New York City and Wilmington, Delaware.
