NOTE: This position is a tiered position. Incumbents will have a position level assigned based on their skills and experience, and in alignment with position development plans. Position placement is at Amtrak’s sole and absolute discretion.

 

SUMMARY OF DUTIES:

 

This position is responsible for the day-to-day administration of Evidence Preservation processes and
tasks related to accidents and incidents arising from or involving Amtrak operations which give rise to
possible claims of injury and/property damage. This position is focused upon managing as well as
developing protocols for the technological aspects of identifying and managing digital evidence, i.e.,
video, event recorders, positive train control (PTC), electronic data and discovery. It will also serve as
an advisor between the external vendors responsible for storing and designing encrypting capabilities
of videos downloaded from Amtrak equipment and stations and internal Amtrak departments to
include Claims/Law.Position is also responsible for: assisting the Claims department in creating and designing database
generated reports, developing and disseminating, with limited oversight, training Administrative
Assistants and Claims personnel in evidence preservation policies and procedures; providing support in
prosecution and defense of tort claims/litigation involving Amtrak or railroads and commuter agencies
with which Amtrak has operating agreements; ensuring accurate and efficient records management,
comprehensive database organization and maintenance; issuing retention memos for potential litigation
holds and maintaining a current list of document custodians to comply with Amtrak’s legal
responsibilities in conjunction with Claims professionals and management responsible for ensuring
compliance with FRA regulations and requirement.

 

ESSENTIAL FUNCTIONS:

 

• Monitoring, assessing, and providing insight and guidance regarding effective methods to capture,
retain and protect digital evidence vital to Amtrak’s defense.
• Must give continual attention to detail in developing reports, coding, typing and proofing materials,
establishing priorities, and meeting deadlines.
• Serving as the primary point of contact throughout the discovery lifecycle, applying in-depth
knowledge and experience to provide expert consultation and advice on technology and best
practices regarding evidence (digital and physical) collection and preservation.
• Assist with the identification, location, and capture of digital and physical evidence in accidents
and incidents involving Amtrak to ensure its preservation.
• Receives, collects, stores, documents, preserves, ships, transports, disposes of, maintains chain of
custody of, and accounts for evidence in various forms using defined evidence handling policies,
practices, and procedures.
• Prepares detailed paperwork pertaining to evidence and submitted items, including inventories and
chain of custody forms.
• Tracks, ships, transports, and accounts for evidence preserved and transferred to appropriate
technical experts, legal counsel and other third parties.
• Collaborates with Claims personnel to establish new evidence handling requirements by and
researching, testing, analyzing and recommending solutions/improvements for approval.
• Establishes and maintains working relationships with law enforcement personnel and industry
peers.
• Guide and assist Claims personnel in developing and providing evidence preservation training
sessions to advise company personnel in proper evidence identification and handling techniques.
• Liaison for in-house counsel, Operations staff and outside counsel concerning evidence
preservation resources and system improvements.
• Ability to exercise discretion while working and communicating in confidential settings with
sensitive information.
• Occasional travel to various work locations, to include outdoor settings (approximately 25%
travel), required to respond to business requests after hours, weekends, and holidays, as needed.

 

MINIMUM QUALIFICATIONS:

 

• Bachelor's Degree or equivalent work experience.
• 0-7 years of relevant experience
• Experienced in and familiar with computer coding, (JavaScript | AngularJS | SQL | C#*)
• Ability to multi-task in an environment that is demanding, fast-paced and deadline driven, typically
under time constraints to produce evidence based on court-driven demands.
• Expert in the use of standard office computer hardware and software (Microsoft Office Suite)
• Expert in preparation of spreadsheets, pivot tables, graphs and charts
• Ability to work well within all levels of the organization, especially internal and external senior
management.
• Fluent in English – oral and written communication.
• Reliability, with a focus on personal integrity.
• Significant experience working within diverse environments.
• Excellent interpersonal skills.

PREFERRED QUALIFICATIONS:


• A working knowledge of SQL and complex relational databases with the ability to build to
reports from a relational databases using varied programs, ie Cognos, Tableau and Business
Objects.
• Demonstrated familiarity with railroad operating department functions related to job duties and
evidence preservation rractices.
• Experience with Global Positioning Systems and Vehicles.
• Demonstrated experience with Amtrak’s business systems (SAP/SAM, Business Objects, Passport,
ASIS, ARROW, E-Trax, EIP, TCD (including LDVR interface and data preservation).
• Experience with computer forensic hardware and software.
