SUMMARY OF DUTIES:

Protect the fiduciary interests of the Corporation through prompt investigation and administrative handling of personal injury and property damage claims brought by passengers, employees and others.

 

ESSENTIAL FUNCTIONS:

• Thoroughly investigates liability and damages aspects of accidents/incidents involving reports of personal injury and property damage.
• Establishes appropriate liability accruals/reserves and assures the claims database is accurate and current.
• Contacts claimants promptly, provides assistance, and monitors medical treatment.
• Evaluates claims and lawsuits with respect to liability and damages to determine corporate exposure.
• Accomplishes the fair and equitable disposition of claims and lawsuits by negotiating settlements with claimants and opposing counsel.
• Assists outside counsel in prosecution/defense of lawsuits filed by and against Amtrak.
• Maintains liaison with other departments to ensure effective communication and complete cooperation on claims related matters.
• Mentors less experienced co-workers.
• Manages higher risk, more complex claims and lawsuits with minimal supervision.
• Ability to exercise discretion while working and communicating in confidential settings with sensitive information.
• Takes on managerial duties as needed/assigned by supervision. 
• Interior and external work (including office work, visiting shops and facilities, courthouse and attorney offices) and working in field environment outside with varying weather, noise levels and lighting conditions and uneven walking surfaces including ballast.
• Occasional work away from home, weekends, holidays, odd days and/or shifts.
• Must have access to transportation for use to fulfill work requirements, such as travel to accident and training sites, court appearances, etc.
• May involve responding to accident sites as needed in a variety of hours, including at night.

 

MINIMUM QUALIFICATIONS:
• Baccalaureate degree or equivalent work experience 
• Experience in personal injury claims including litigation experience.
• Ability to attend and pass required training to include RWP training and Claims School.
• Demonstrated experience managing and resolving litigated cases.
• Excellent interpersonal skills.
• Demonstrated organizational skills.
• Excellent verbal and written communication skills.
• Ability to proficiently use Microsoft Office Suite.
• Familiarity with medical terminology and railroad operations. 
• Ability to manage a large work load with attention to detail.
• Ability to deal fairly and effectively with a wide variety of people.
• Must be a team player, able to work under stress and maintain professional composure.
• Ability to teach claims skills to less experienced co-workers.
• Ability to negotiate effectively with claimants, attorneys and involved stakeholders.  
• Litigation experience. 


PREFERRED QUALIFICATIONS:

• 3+ years experience
• Significant experience in railroad personal injury claims.
• Experience with Microsoft Office 365.

 

WORK ENVIRONMENT:
• Interior and external work (including office work, visiting shops and facilities, courthouse and attorney offices) and working in field environment outside with varying weather, noise levels and lighting conditions and uneven walking surfaces including ballast.

• Must have good visual acuity and hearing capability sufficient to perform the essential functions of the job unless other vision or hearing standards are required.
• Must be able to lift, carry, push or pull loads in accordance with applicable standards.
• Will be required to bend, stoop, stand and climb in performing daily tasks and activities.

 

COMMUNICATIONS AND INTERPERSONAL SKILLS:

Must have excellent oral and written communication skills.

 

The salary/hourly range is $78,600-$101,844, Pay is based on several factors including but not limited to education, work experience, certifications, internal equity, etc. Depending on an employee’s assigned worksite or location, Amtrak may consider a geo-pay differential to be applied to the employee’s base salary. Amtrak may offer additional incentive and pay programs to recognize and reward our employees, including a short-term incentive bonus based upon factors such as individual and company performance that is commensurate with the level of the position and/or long-term incentive plan compensation.
